Man Indicted for First Degree Murder in Hillsborough Deputy's Death

TAMPA -- Hillsborough State Attorney Andrew Warren's office says a grand jury returned a first degree murder indictment against 28 year old Travis Garrett Thursday.

Under Florida Law, prosecutors aren't allowed to go forward on a capital murder charge unless a grand jury signs off.

Garrett is accused of targeting Sergeant Brian Lavigne with his car after fleeing from other deputies investigating a disturbance at his apartment complex. Prosecutors say he also attacked two deputies and resisted arrest with violence, as they were investigating a disturbance January 11th, then drove off, smashing his car through an iron gate.

Lavigne died in the crash. He was just days away from retirement.

Garrett faces nine other charges, including two counts of battery on a law enforcement officer.
